Why is it important to track Marketing Preferences?
The General Data Protection Regulation (GDPR) is a comprehensive data privacy law that took effect in May 2018, and it applies to all companies that process or handle the personal data of European Union (EU) residents. The GDPR provides a set of rules and regulations that aim to protect the privacy and data rights of individuals, and it requires companies to obtain explicit consent from individuals before collecting, using, or sharing their personal data for marketing or other purposes. In the wake of GDPR coming into effect, many other jurisdictions have established similar legislation with requirements about obtaining an individual's consent to marketing messaging.
It's essential to track a contact's consent status because doing so helps you comply with GDPR and other similar data privacy regulations. By tracking consent, you can ensure that you have the necessary legal basis for sending marketing messages to individuals, and you can demonstrate that you've obtained explicit consent or have a legitimate interest in contacting them.
Accessing the Marketing Preference Manager
To access the Marketing Preference Manager, go to "My Contacts" on the left-hand sidebar. If you are an admin user, you can also go to "All Contacts". Then, select the contact for whom you want to view or edit marketing settings.
You will see a slider come out from the right side of the page with more details about this contact. Within the contact slider, you'll see a tab labeled "Marketing Settings" on the right side. This is where you'll find the Marketing Preference Manager.
How to use the Marketing Preference Manager
Consent Management
Under the "Marketing Settings" tab, the first thing you'll see is the "Consent Management" section. Here, you can view and edit the consent status that a particular contact has given for one-to-many marketing, which is important for GDPR or similar regulations.. Note that this type of consent is not needed for one-to-one communications.
If you have opened a Contact that is marked as a Client, you will notice a disclaimer that says the Contact has automatically been set to "legitimate interest." This is true for all Contacts associated with Companies for which the Company Type has been set to Client.
You can edit a contact's consent by clicking the edit button on the right side of the Consent Management section. There are four options for setting consent status:
Consent given: the contact has given explicit consent for marketing messaging
Consent not given: the contact has not given explicit consent for marketing messaging but has not unsubscribed or opted out
Legitimate interest: your firm has a legitimate interest in contacting the individual
User unsubscribed: the user has explicitly unsubscribed or opted out of marketing messaging
Note that setting the status to "User unsubscribed" will prevent the Contact from being added to any Marketing Lists in Nexl.
Preference Management
The next section is "Preference Management", which is a customizable section that allows you to set additional marketing preferences beyond your legal basis for marketing. For example, if you have multiple newsletters for different practice areas or subjects, you can use this section to track which specific lists a Contact is signed up to. This section can also be configured for or any other type of preference that you would like to track, such as other preference fields available within your email marketing system.
To utilize the Preference Management section, your custom preferences must be configured by Nexl's Client Services team. To add a new set of custom preferences, please contact us by email or via the chat button in the bottom right corner of the Nexl platform.
Once one or more sets of preferences have been configured, you can add custom preferences to a Contact via the "Add Preference" button in the Preference Manager.
List Membership
At the bottom of the Marketing Settings tab, you will see the "List Membership" section. If this Contact has been added to one or more Marketing Lists, you will be able to view and edit their list memberships within this section, using the "Add" and "Remove" buttons.
Setting Marketing Preferences in Bulk
In addition to managing Marketing Preferences for individual Contacts via the Contact Slider, Admin users can also use the import function to import a list of consent statuses. For example, if you are able to export your subscribes and unsubscribes from your email marketing system, you can use the exported list to set multiple statuses at once.
